In many municipalities there is a desire and possibility to (re)develop a large area. Such planning developments will take a lot of time, involving different parties in the different phases. Every participant will have its own interest and business case, whereby successful total development is only possible when all players work together. The most important partner in this case will come from the government side. It is bound by public law regulations and strict requirements under procurement law. There have been many developments in legislation (such as the new Environmental Act) and case law (including European rulings) in these areas of law.
In the cooperation between the party on the part of the government and the market party for the (re)development, can be contracted with a simple agreement. It is also possible for the parties to set up a legal entity in which they work together.
